That's the thing, Reser - if you look at the standard T&Cs, it actually is a contract of sorts... and, just for argument's sake, if a minor were to use a rtg phone for illicit activities, a few parties would wanna cover their legal butts, wouldn't they?
Dito, in so far as the sim is actually property of the network (which is why they can 'kill' it if you don't use it for 6 months), and they subsidise the handset (which is why they can brand it and deny software updates etc)...it really is a contract - and as a matter of fact: every purchase is a 'contract' - sell a pencil to a kid and watch a parent try to return it, and you see the implications of dealing with a minor who's quite okay with shopping, but when problems arise 's/he's just a kid'...
Every purchase transaction is a contract Minor or adult: you have warranty rights and 'duties', and that is why retailers may refuse to enter into certain 'contracts' with children - legally, a child is not always 'competent' to understand warranty T&C's... Etc yada yada
But I'm off on a tangent - I have seen plenty of 'kids' buy plenty of phones. So, no problem there, methinks.
