Good news if you’re keen to get your hands on the super-slim Samsung Galaxy Tab 10.1: the preliminary injunction has been temporarily lifted. Er, unless you live in Germany.
The injunction, which prevented sale of the Galaxy Tab 10.1 across Europe (other than the Netherlands), has been lifted pending Samsung’s appeal, scheduled for August 25.
It’s not entirely clear why the injunction has been lifted, though yesterday we reported that a comparison image of the Samsung Galaxy Tab 10.1 and iPad 2 – as included in Apple’s complaint – appeared to have been doctored.
Florian Mueller of Foss Patents also suggests there might’ve been some confusion between the definition of “establishment” and “subsidiary” in German and English.
If Samsung’s appeal is upheld by the Regional Court of Dusseldorf, Apple might find itself having to pay significant damages to its South Korean friend.
