Samsung suing Apple over iPhone 5 LTE

Samsung suing Apple over iPhone 5 LTEIt was rumoured at the end of August, weeks before the device even launched, and now we have apparent confirmation.

Samsung, recently ordered to pay Apple over $1 billion in damages (though Apple wants three times that), will sue its Californian friend over the iPhone 5’s LTE technology.

That’s the story according to FOSS Patents, a thoroughly reliable and reliably thorough (try saying that three times fast) source when it comes to legal stuff.

Jim FOSS (not a real guy, unfortunately) reports that Samsung filed an initial gripe on Wednesday, predicting that the iPhone 5 will infringe on its LTE patents.

Sammo promises to “file a motion to amend its infringement contentions to address the iPhone 5 as soon as it has had a reasonable opportunity to analyze the device". The iPhone 5 is, of course, out today.

Jim adds that Samsung could seek a preliminary injunction against the iPhone 5, though it's not specifically mentioned in the filing. Yeah, good luck getting that approved in California.

A few weeks ago, Apple added the Samsung Galaxy S III and Galaxy Note to an ongoing thing with the blah blah blah.

And the patent wars roll on…

Might as well save their efforts and not bother as it is the same judge as last time.
As it's being added to the suit against other products it's not as if it's all about lte surely anyway.

I hate to say it but if you are calling Florian Mueller of FOSSPatents a reliable source you drank the koolaid. I haven't seen anything dealing with Google vs Oracle, or Android vs XXXXX be reliably accurate.

APPLE is sueing samsung over shapes, here is what i have to say, Apple is mad cuz they cant think of another design and keep making the same phone over and over changing the cover color and adding a few apps and the worst decision ever was to try and create their own mapping software, lol what a joke a app that is supposed to help you does nothing but take up space. The only good thing is that now with their precisous iphone 5 and a map app that is as good as our govt the liberals wont be able to find their way to the poll, but people will still flock to them like puppets no matter how much apple charges for a pile of ****. They are blind and only think 1 dimensional when they hear the word iphone and if u have ever talked or know someone with an iphone they can tell you just about everything about every iphone made and every 5 or 6 words out of their mouth is either iphone or apple. Apple is over rated, we need to get rid of apple and obama maybe after that there would be piece on a green earth (don't think apple is going anywhere though)

JanSt / MOD  Sep. 22, 2012 at 19:41

Tell me you're kidding?!

Here, lemme make your weekend perfect:

no matter how hardcore an Android fanboy you are or how much you hate Apple for whatever reason, you can’t disregard the fact that Samsung brought this **** storm on to itself by blatantly copying Apple’s devices

the article said that it is the same judge and with samsung going to be able to win the case "good luck on that" what does that mean? if apple infringed should it matter where they are at the law is the law if they infringed then that should be that!!!!!! and by the way i am not an apple or android fanboy i have owned all the iphone all the way from the first one "silverback" to the iphone 4s and now i own the galaxy s3 and im sorry to say the s3 is WAY better in all aspects HANDS DOWN of course that is imo but this is coming from some1 with a lot of experience with iphone. i had friends that waited in line to get the iphone and now they see how the new Iphone really is the wish they went with the s3 LOL they are planning on returning it though some have 15 days and some have 30 days to do so but still the disappointment in the iphone

Fair enough.
You used all iPhones (bar the last one), and you moved on to the SGS3. It suits you better.
You're happy. The universe smiles. Case closed.

Your friends, pardon me, are fools for queuing for and buying a phone they haven't tried.
I have no sympathy. At all. Be it an iPhone, and SGS3 or a Nokia 6300... try before you buy, or silently move on. The SGS3 has been out for months. The iPhone 5 was specced prior to launch. If they didn't know the differences between the 2, YOU, as an informed consumer should have done a better job :p

Furthermore, there's a shortage of iPhone 5s - your friends can sell them easily.

Saying a phone X is superior to phone Y is not all that clever, either. Not everybody on the planet has the same taste, the same preferences, the same needs and wants.
People who don't want a large screen (4in +) have fewer and fewer options when trying to buy a high-end device. (rumours are Google's next Nexus will be a 5-incher).
People who invested a lot in iOS apps have further reason to stick with iOS - just as Android fans who bought a lot of apps have reason to stay with Android.
Or consider this: a lot of people - the majority in fact - USE phones. They are JUST phones, not a lifestyle. Not a toy of infinite possibilities to try out tweaks and ROMs and etc...
When one just wants a phone, relearning an OS is not always desirable. That is why many people stay with an OS - it has little to do with being a fanboy, a sect-member or brand-loyal. It's simple convenience. That is why 20 million people bought the Nokia N97 even though it was obviously rubbish - they knew the OS, the set-up took 2 minutes coming from another Nokia, they knew the email client, the store, the apps, the USSD codes etc etc....

Tell me - if you want a phone that isn't 4.3 inches or bigger which one to get?

I used an SGS3 and I used the 4S - I have a fairly good idea about the iPhone 5. also. Now explain to me HOW the SGS3 is superior in every single way. No generalisations. I want your opinions. Your preferences. Your exact reasons. Because generalisations won't help folks looking to buy a phone now. They need specifics. Or they end up like your unhappy friends.

As to the article being 'the worst' ever - same thing: why? How? And: do you realise these are blog articles, not the gospel according to Lewis? They are up for debate - thus the comment boxes. Lewis isn't the mobot party spokeman. He writes from his POV.

First off, the reason why I said this is the worst article is because it stated that the reason why Samsung wouldn't win the case is because if it being the same judge and the geography of where the case would be held. If there is an infringement on a copyright then Samsung should win, the law is the law and that is all there is to it. Also it will not be the same judge handling it it will be this judge and this is what he had to say

Quote:

U.S. International Trade Commission Judge Thomas Pender said Thursday that "clear and convincing means something to me," addressing the guidelines for determining whether a patent should have been issued. "I have to be pretty darn certain a U.S. patent is invalid."

So get your facts straight!!!

Secondly, My friends (who are not fools and for you to even comment on them saying that they are is totally appalling, very unprofessional, and rude especially considering you don't even know them) did try out both phones, that is why they waited til the iphone 5 came out so they could try them both out hands on. Also the reason why they wont sell the iphone 5 is because they can just return it with there 15 to 30 trial period with there carrier and they can get the S3 without having to buy it srtaight out which is a very smart move.

Thirdly, How did the Nokia even come into your reply considering the topic of this article is "Samsung suing Apple over iPhone 5 LTE". Now i know Nokia does make great phones, but i will not be getting one because it runs Windows and they are in last place when it comes to the sell phone market and they have the smallest app store out of all of them.
Also when i made my statement about the S3 Vs the Iphone and i said the S3 was way better i said that that was IMO (which stands for IN MY OPINION) since you didn't happen to catch it the first time. And it is true people do deserve to have there opinion that is just mine, S3 wins hands down.

Fourth and lastly, you wanted the reasons why I believe that the S3 wins hands down this is why

1. The screen. The S3 is a 4.8in screen which is a 1080x720p true HD and the apple is a 1,136 x 640 and no HD
2. The processor. The S3 is a 1.5ghz processor that can be overclocked to 1.8ghz the Iphone 5 is a 1.2ghz processor
3. The ram. The S3 has 2gb of ram and the iphone 5 only has 1gb
4. The memory. The S3 has a 16, 32 and 64 gb internal but you can just get the 16gb version for $199 or less and add an external 64gb micro sb card giving you 80gb. On the Iphone 5 the prices are about the same but it has NO EXTERNAL memory and will never reach the 80gb mark
5. The removable battery. On the S3 you can remove your battery if it goes dead and just replace it but on the Iphone 5 you can not so you would have to find a place to recharge it.
6. Also on the battery. The S3 has longer battery life being that it is a 2,100mAh and the Iphone is only 1440 mAh. The S3 can last 3+ hours longer
7. The OS. Now this may be IMO but i think that Android is better than IOS6, but the Android is way more open and thats a fact. If i want to ad a movie, a song, or whatever i just need to hook it up to my computer and copy and paste to my internal/external sd and thats it. on the Iphone you have to use Itunes which can be a pain if your settings aren't set up to what you like and plus you have to use a computer that is set up to your Iphone.
8. The Connectivity. The Samsung uses a Standard MHL/HDMI cable which is very handy because you can connect it to so many devices. Plus you can hook up a PS3 controller to it and it will work. Also you can just hook up a HDD and drag your files over, the iphone won't do that. The Iphone hooks up a different way, THERE WAY, and for you to use the iphone 5 you have to buy THEIR new special adapter to be able to hook it up to any of your old devices granted if it will fit in the old devices cradle.
9. New Technology. The S3 has NFC which is very handy for transferring files, photos or whatever else you want to transfer to another phone that has NFC. The Iphone 5 DOES NOT have NFC.
10. Also. On the S3 you can charge your battery through wireless the Iphone 5 CAN'T

So there you have it the reason why I think the S3 is better than the Iphone 5 and these are facts not opinions. As you can see, my friends and I did our homework before going with one or the other and that proves we are not FOOLS. BTW, who do you think you are criticizing use, your viewers like that and calling names, boy i am still mad about that. And by the way you are not pardoned

Also can't this guy fight his own battles without you???

Why? I don't know? Maybe he doesn't find it worthwhile? You said: "by the way i agree with CONSERNED this is the worst article i have ever read straight up garbage" [By the way - Lewis 'responded' to your Mencken-esque critique - you just haven't found it ;) ]

Your reasons are very good reasons for choosing the SGS3 over the iPhone 5. Good for you.
AS TO =>
As you can see, my friends and I did our homework before going with one or the other and that proves we are not FOOLS. BTW, who do you think you are criticizing us

Ironic, you ask why Lewis doesn't fight his battle, when you do "our" homework. In your original post you make your friends out to be victims of Apple's evil, misleading PR.
That is why I called their decision foolish. Not to offend them, NONE of the points you mention in favour of the SGS3 were unknowns. THAT is my point! They may be very nice, intelligent and caring 'fools'. but in those few seconds it took to hand over the money for the iPhone 5, the fool centre took over their brain. No harm. I have bought stupid things in my life.

Furthermore, with regards to my defending Lewis: I'm NOT.
I would 'defend' Bush or Goebbels IF and when the arguments against them are wrong. I'm arguing against opinion dressed up as gospel.
We gain nothing from fake objectivity.
YOU implicitely (maybe unintentionally so) OFFEND every one who owns an iDevice, simply because those devices don't SUIT you.

And, "boy are you mad at me"? Wait, you called this the worst article ever without (initially) giving any reasons for that judgement; you declare Apple misled your poor, well-informed friends, you implicitely and explicitely belittle every one of the 10s of millions of phone buyers who disagree with your PERSONAL choice...
As to the Nokia - really? You don't understand my bringing it up? Okay...
But I offended you?!? Blimey, am I amused. As a person with strong convictions who, just-so, logs in here to spout unexplained criticism, you gotta learn to take as well as you give. Shouldn't be too hard, come to think of it.
Enjoy your choices; don't force them onto others, or open a polite ad company.

PS: "reason why I think the S3 is better than the Iphone 5"

You know the difference between thinking and believing? Your reasons may well be factual, and the relevant ones for your process of elimination on the route to a new phone. They are NOT fact to any single one else. If you do not 'get' that we have nothing to talk about.
As to the specs comparison that you rattle off... Gosh, I hadn't noticed that the SGS3 is bigger than the iPhone. Those devious Apple folks got one over me. Thanks for the correction. Since 100% of all the whole world want really big phones, that is a true scandal.
The rest? Irrelevant. The iPhone and the SGS3 run different OSs. A direct spec-to-spec comparison makes no sense. It's IRRELEVANT. If it wasn't, my Nokia N9 wouldn't be able to run 20 apps - TRUE multi-tasking - without problems.
